Practicly Newsletter Terms
Last updated: 19.10.2026 Version: 1.0 Effective from: 19.10.2026
Section 1. General Provisions
- These Terms set out the rules for the electronically supplied Practicly newsletter service (the "Newsletter").
- The service is provided by Michał Cieśla, conducting sole proprietorship business under the name Enovic Inteligentne Instalacje Michał Cieśla, with its registered place of business at ul. Marynarska 12, 05-825 Kady, Grodzisk Mazowiecki municipality, Mazowieckie voivodeship, Poland, Tax ID (NIP): 5060063248, Statistical Number (REGON): 365266100 (the "Provider").
- The Provider can be contacted at: [email protected].
- These Terms are made available free of charge before subscribing, in a form that allows them to be downloaded, reproduced and stored.
Section 2. The Newsletter
- The Newsletter is free email from the Provider about the Practicly product, new features and offers.
- The Newsletter is a service separate from those provided in the Practicly service under its Terms of Service. It does not require an account. Not subscribing, or unsubscribing, has no effect on an account, on access to the service or on subscription terms.
- Using the Newsletter requires a device with Internet access and an active email account.
- Subscribers may not supply unlawful content, in particular another person's email address without that person's consent.
Section 3. Subscribing
- A person subscribes to the Newsletter by:
- entering an email address in the form in the service's footer, ticking consent to receive commercial information, and confirming through the link sent to that address (the link is valid for 48 hours); or
- consenting to receive commercial information by email when registering an account, in a question shown in the service, or in the account settings; or
- entering an email address in an Event's registration form (Section 4) and ticking consent to receive commercial information, and, where the address does not yet subscribe to the Newsletter, also confirming through the link sent to that address (the link is valid for 48 hours).
- The agreement for the Newsletter is concluded for an indefinite period when the subscription is confirmed through the link or consent is given in the service.
Section 4. Online Events
- As part of the Newsletter, the Provider may run free online events, in particular webinars (the "Events"). An Event's page in the service sets out its date, topic, hosts and the platform it is streamed on.
- Registering for an Event is free and requires subscribing to the Newsletter. A person already subscribed is registered at once; anyone else when they confirm the Newsletter subscription through the link.
- The registration form asks for the email address, first name, professional role and, for some roles, the institution.
- After registration the Provider sends an email confirmation with the link to the stream. Reminders and other information about the Event are sent as part of the Newsletter.
- The Event is streamed on the external platform named on its page (for example YouTube), under that platform's terms. The Provider does not pass registrants' data to that platform.
- Registration closes at the time stated on the Event's page, at the latest when the Event starts.
- Unsubscribing from the Newsletter does not cancel the link sent in the confirmation, but stops reminders about the Event.
- The Provider may cancel an Event or change its date, informing registrants by email.
Section 5. Unsubscribing
- A subscriber may unsubscribe at any time, without giving a reason and free of charge: with one click on the link in the footer of every message, with the switch in the account settings, or by writing to [email protected]. The agreement ends when the subscriber unsubscribes.
- Unsubscribing does not affect account, payment and security messages, which the Provider sends in connection with providing the service.
- The Provider may stop running the Newsletter, informing subscribers by email.
Section 6. Complaints
- Complaints about the Newsletter can be sent to [email protected], describing the problem and giving the email address concerned.
- The Provider handles a complaint within 14 days of receiving it and replies to the address it was sent from.
Section 7. Personal Data
- The Provider is the controller of subscribers' personal data. For data protection matters, the Provider can be contacted at [email protected].
- For the Newsletter, the Provider processes: the email address and, where given, the first name, professional role, institution and language; for people with an account in the service, also the subscription plan name, subscription status and whether the plan is active; on registration for an Event, also which Event the person registered for; and proof of consent (the date and the wording of the consent in its version). The sending provider also records whether a message was opened and whether a link in it was clicked.
- Purposes and legal bases of processing:
- sending the Newsletter and commercial information by email: consent (Art. 6(1)(a) GDPR) and consent to marketing communication (Art. 398 of the Polish Electronic Communications Law of 12 July 2024);
- keeping a suppression list after consent is withdrawn, so that no further messages are sent: the Provider's legitimate interest (Art. 6(1)(f) GDPR).
- The data is disclosed to processors acting on the Provider's behalf: CPC Servicios Informáticos Aplicados a Nuevas Tecnologías, S.L. (MailRelay, Spain; data stored in the EU), which sends the Newsletter, and Amazon Web Services EMEA SARL (Frankfurt region, EU), which provides hosting and sends the message with the confirmation link and the confirmation of an Event registration. Traffic to the service, including the signup form, passes through Cloudflare, Inc. (USA), under the EU-US Data Privacy Framework and standard contractual clauses.
- The data is kept until consent is withdrawn. After withdrawal, the Provider keeps only the email address on a suppression list, so that no further messages are sent, until the account is deleted or erasure is requested. An unconfirmed subscription is not passed to the sending provider and receives no Newsletter; the address is deleted on request.
- Subscribers have the right of access to their data, to rectification, erasure, restriction of processing and data portability, the right to object to processing based on legitimate interest, and the right to lodge a complaint with the President of the Polish Personal Data Protection Office (UODO). Consent can be withdrawn at any time as described in Section 5; withdrawal does not affect the lawfulness of processing before it.
- Providing the data is voluntary but necessary to receive the Newsletter. The Provider takes no decisions about subscribers based solely on automated processing.
- Matters not covered by this Section are governed by the Privacy Policy.
Section 8. Final Provisions
- The Provider may amend these Terms for important reasons, in particular a change in the law or in how the Newsletter is run, informing subscribers by email at least 14 days before the change takes effect. A subscriber who does not accept the change may unsubscribe under Section 5.
- Matters not covered by these Terms are governed by Polish law. These Terms do not limit the rights consumers have under mandatory provisions of law.
- In case of any discrepancies between the Polish and English versions of these Terms, the Polish version shall prevail.
- These Terms take effect on 19.10.2026.
These Terms are in effect as of 19.10.2026.
